Compliance with Australian Privacy Principles

Cloud4x strictly adheres to the Australian Privacy Principles (APPs) outlined in the Federal Legislation, specifically the Privacy Act 1988 (Cth). These principles govern the collection, holding, use, and disclosure of personal information. As of 12 March 2014, both the private and public sectors in Australia are mandated to comply with the 13 new APPs under the Privacy Act.

Definition of Personal Information

Under the Privacy Act, personal information is defined as “information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether recorded in a material form or not.” This includes email addresses, among other identifiers, while anonymous information such as statistical data is not considered personal information.

Cross-Border Disclosure and Security

Agencies and businesses dealing with personal information must adhere to APP8, which regulates the cross-border disclosure of personal information. Before transferring personal information offshore, entities must take reasonable steps to ensure compliance with the APPs, typically through contractual provisions. Additionally, APP11.1 mandates organisations to implement security measures to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure.

Data Ownership and Protection

When you entrust your data to Cloud4x, you retain ownership of the data. Cloud4x acts as the custodian or processor of your data, and you maintain the rights, title, and interest in your stored data. We do not mine your data for advertising purposes and only utilise it for purposes consistent with providing you with cloud productivity services.

Our Role as Data Processor

As a data processor, Cloud4x only utilises your data for purposes aligned with the services you subscribe to. We are committed to transparency and regularly disclose law enforcement requests through our transparency reports. In cases where a government seeks access to customer data, we prioritise redirecting the inquiry to you, the customer, and challenge any invalid legal demands in court.
